Terms of use

1. Provider and scope

These terms apply to the klubfish app and the website klubfish.com. The provider is Johannes Claudi, Amsterdam, the Netherlands, e-mail privacy@klubfish.com.

2. What klubfish is

klubfish is a shared fishing logbook for you, your friends and your club. It is free to use and has no ads. klubfish is currently a beta, open by invitation only: features may change, be added or be removed, and there is no right to be let in.

3. Your account

You must be at least 16 years old. An account belongs to one person. Use an e-mail address only you can access, because anyone who can read your e-mail can sign in with the code. Never pass on sign-in codes.

4. Your content

Your catches, photos and notes remain yours. So that klubfish works, you give us a non-exclusive, free right to store them, process them technically (for example resize photos and remove their capture data), show them to the people you have chosen, and include them in your clubs' evaluations (records, rankings, catch lists). We do not use your content for anything else.

This right ends when you delete the content or your account. Excepted are copies others have lawfully made (for example a catch list your Verein exported) and backups until they are overwritten.

5. Photos and other people

Upload only photos you took yourself or are allowed to use. If other people can be recognised in a photo, ask them first.

6. Rules of conduct

On klubfish you may not:

• post illegal, insulting, threatening or discriminatory content,
• pretend to be someone else or knowingly log false catches for others,
• pass on other people's data, in particular spots, beyond what they have shared themselves,
• post advertising or spam,
• collect data automatically, attack the service, or try to get around security or visibility settings.

7. Clubs, rules and waters

A club's admins are responsible for its content (rules, waters, events, announcements, member management). Rules such as minimum sizes, closed seasons and bag limits are entered by the club itself; klubfish does not check them: as stated by the club, without guarantee.

Hints in the app (for example “under the minimum size”) are an aid, not legal advice, and they never stop you saving. You are responsible for complying with fishing laws, your permits and the rules of your water.

A Verein's fee list is only an overview. No money moves through klubfish.

8. Availability, offline use and backups

We aim for a reliable service but cannot promise it is always available, least of all during the beta. Catches logged without a connection are stored on your device and sent once you are back online. If you clear the app's data in your browser before that, those catches are lost. With “Download my data” you can take your own copy at any time.

Weather, maps and place names come from third parties and are without guarantee. Do not rely on the app in thunderstorms, gales or floods.

9. Liability

klubfish is free. We are liable without limitation for intent and gross negligence, for injury to life, body and health, and where mandatory law provides. Otherwise liability is excluded as far as the law permits.

10. Suspension and ending

You can delete your account at any time in the app under Settings › Account; for 14 days this can be undone.

If these terms or the law are broken, we may remove content and suspend accounts. We tell you what we did and why, and you can object by e-mail; we will then review it again.

We may end the beta or the service. We announce this at least 30 days in advance in the app or by e-mail, so you can download your data; except where an important reason requires immediate action.

11. Changes to these terms

If we change these terms, we tell you in the app beforehand. For significant changes we ask you to accept them again. If you do not agree, you can delete your account.

12. Applicable law

Dutch law applies. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can also bring a claim there.
